These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Archemastrie (“we,” “us,” or “our”) regarding your access to and use of the archemastrie.com website, The Merkabah App, and all related services (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

The Merkabah App:

Digital oracle application for mobile and web platforms

Educational Content:

Blog articles and written materials
Video tutorials and courses
Newsletter content
Workshop and training programs (when available)

What We Do Not Provide

Our Services are NOT:

PAYMENT AND BILLING TERMS

Pricing

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. Current pricing is available on our website.

We reserve the right to:

Modify pricing at any time
Offer promotional pricing or discounts
Implement tiered pricing structures
Charge different prices in different regions or currencies

Price changes will not affect Services already purchased but will apply to future purchases.

Payment Processing

Payment Methods: We accept payment via credit card, debit card, PayPal, and other methods as displayed during checkout.

Third-Party Processors: Payments are processed through secure third-party payment processors (Stripe, PayPal, etc.). We do not store your credit card information on our servers.

By providing payment information, you:

Subscription Services (App)

Billing Cycles:

Monthly subscriptions: Billed on the same day each month
Annual subscriptions: Billed once per year on the anniversary date
Lifetime access: One-time payment, no recurring charges

Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date. You will be charged the then-current subscription rate.

Cancellation:

You may cancel your subscription at any time through your account settings
Cancellation takes effect at the end of the current billing period
No refunds for partial billing periods
You retain access until the end of the paid period

Personal Sessions

Booking and Payment:

Payment is required at the time of booking
Sessions must be scheduled through our booking system
Confirmation will be sent via email

Rescheduling:

You may reschedule with at least 24 hours notice at no charge
Rescheduling with less than 24 hours notice may incur a fee
We will make reasonable efforts to accommodate emergency rescheduling

Cancellation:

Cancellations with 24+ hours notice: Full refund
Cancellations with less than 24 hours notice: No refund
No-shows: No refund, session fee forfeited

Late Arrivals: If you arrive late to a scheduled session:

The session will end at the originally scheduled time
No extensions or refunds for time lost due to late arrival
Sessions more than 15 minutes late may be cancelled at our discretion

Refund Policy

App Subscriptions:

Monthly subscriptions: No refunds for partial months
Annual subscriptions: 30-day money-back guarantee from initial purchase
Lifetime access: 30-day money-back guarantee from initial purchase
No refunds after 30 days except as required by law

Personal Sessions:

Full refund if cancelled 24+ hours before scheduled time
100% satisfaction guarantee: If you’re not satisfied with your session, contact us within 7 days for a full refund
Written readings: Full refund if not delivered within promised timeframe

Refund Process:

Refunds are processed within 7-10 business days
Refunds are issued to the original payment method
Processing times vary by payment provider

Taxes

You are responsible for all applicable taxes, including sales tax, VAT, GST, or similar taxes based on your location. These may be added to your purchase at checkout.

Chargebacks and Disputes

If you dispute a charge:

Chargeback Consequences: Initiating a chargeback without contacting us may result in:

Loss of access to all Services

USER CONDUCT AND RESPONSIBILITIES

You agree to use our Services only for lawful purposes and in accordance with these Terms.

Transmit harmful code, viruses, or malware

Your License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

Use the app on devices you own or control

You May NOT:

Distribute, sell, or sublicense our content
Remove copyright or proprietary notices

“Archemastrie,” “The Merkabah,” “Source’s Light Codex,” and “The Ora” are trademarks of Archemastrie. Unauthorized use is prohibited.

You May:

Save and reference your personal readings
Share insights privately with trusted individuals

You May NOT:

Republish readings publicly without permission
Use readings for commercial purposes
Attribute our interpretations to yourself
Claim our methodologies as your own

Copyright Infringement Claims

If you believe content on our Services infringes your copyright:

LIMITATION OF LIABILITY

Maximum Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

TERMINATION

Effect of Termination

Upon termination of your account:

We may delete your data after a reasonable retention period
Outstanding payment obligations survive termination

Data After Termination

Personal session recordings: Retained for 1 year or deleted upon request
App data: Deleted within 90 days of account closure
Payment records: Retained for 7 years for legal compliance
You may request immediate deletion by contacting us

DISPUTE RESOLUTION

Informal Resolution

Before filing any formal claim, you agree to contact us at legal@archemastrie.com to attempt informal resolution. We will work in good faith to resolve disputes amicably.

Desired resolution

We will respond within 14 business days.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to conflict of law principles.

Jurisdiction and Venue

For Users in the United States: You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Connecticut, and you consent to personal jurisdiction in these courts.

For Users Outside the United States: Disputes may be resolved in the courts of Connecticut or your local jurisdiction, as applicable under international law.

Arbitration Agreement (Optional – U.S. Users)

IF YOU ARE A U.S. RESIDENT, YOU AGREE TO THE FOLLOWING ARBITRATION PROVISION:

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

In any dispute, the prevailing party may be entitled to recover reasonable attorneys’ fees and costs.

MISCELLANEOUS PROVISIONS

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Archemastrie regarding the Services and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms or our rights and obligations without restriction.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

Natural disasters
War or terrorism
Government actions
Internet or utility failures
Epidemics or pandemics
Acts of God

Independent Contractors

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and Archemastrie.

Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated.

Section headings are for convenience only and do not affect the interpretation of these Terms.

Language

These Terms are written in English. Any translations are for convenience only. In case of conflict, the English version controls.

You consent to receive electronic communications from us, including:
